Image Request Guidelines
(for fansites requesting free use of my images)

 

1. The Website must have an active URL and be on-line and fully functional before the request is made (I must be able to view the Web site content before I can issue a limited license for free use of my images).

2. All requests must include the URL of the actual Website the image is to be used on.

3. The fansite may be an officially endorsed celebrity Website or a second-party site not endorsed by the celebrity.

4. Requests will be answered using the contact e-mail address listed on the Website. If you do not have a contact hotlink on your Website, I cannot verify that the owner of the Website is the one actually making the request.

5. Free image use requests are not granted on an exclusive basis, and more than one site may be issued a limited license for use of the same image(s). ONLY the images in the index are available, any other image requests must be made through my photo agency and if available, purchased.

6. The Website must be a non-commercial entity (however, banner advertising and second party ads, used on a limited basis, will not necessarily qualify the site as commercial). It is up to my sole discretion whether a site is commercial or not. This is a very gray area, and I call them as I see them.

7. The fansite, must be just that, a FAN site. Sites having content dealing primarily with celebrity bashing, derogatory comments, rumor mongering, x-rated material, etc., are not considered by me to be a FAN site, and will not have their requests honored. In the case of Websites having a message board system, messages posted on the board by users of the system are not considered to be the same as content published by the Webmaster or Webmistress, and will not be automatically excluded for that content. I shouldn't have to explain the difference between general criticism and bashing, should I.

8. If your Web fansite meets all the above criteria, I will grant you via e-mail, a written limited use license to display the image(s) requested. The image(s) requested will be included in this same e-mail. Do not use any other image(s) other than what I e-mail you! The license grants you the right to use the image(s) without any fees or royalties due me or my photo agency, StarLens, under the following conditions:

  • A. I retain my copyright and all other reserved rights to the image(s).

    B. You may not transfer the limited use license, image(s), the copyright, or any other rights to a third party.

    C. You may not modify the image(s) in any way.

    D. The image(s) cannot be used commercially, and no fee must be paid by your Web site visitors in order to view the image(s).

    E. You must list the photo credit and link back in the style and manner described in the e-mail containing the limited use license and image(s).

    F. The limited use license granted to you by me is revocable at any time.

9. In the event that you are using an image that is purchased "exclusive" by a client after I have granted you a limited use license, you must agree to remove the image(s) so affected within seven (7) days of receiving the request by me or my agent via e-mail. The e-mail requesting such action, will be considered prima facie evidence of the request being made and date of the request.

10. In the event after having granted you a limited use license, I or my agent request that the image(s) be removed from your Website (without cause), you agree to comply with such request within 72 hours of the request being sent via e-mail. The e-mail requesting such action, will be considered prima facie evidence of the request being made and date of the request.
